How to Buy Property in Cuba from Miami: What Cuban Law and US Rules Allow

Miami is the heart of the Cuban community outside the island, and one of the questions we hear most is: can I buy a house in Cuba while living in Florida? The answer has two parts — what Cuban law allows, and what US law restricts.

What Cuban law says

Home sales are allowed between Cuban citizens residing in Cuba and permanent residents (Decreto-Ley 288/2011). Cuban-Americans without Cuban residency usually act through a family member on the island, recover residency, or receive property by inheritance or donation. What US law says

This is where Miami buyers must be careful. The Cuban Assets Control Regulations, administered by OFAC, restrict US persons from most transactions involving property in Cuba. Some family remittances are authorised, but buying real estate in Cuba as a US person is generally not an authorised transaction. Before sending any money for a property, speak with a US attorney who knows OFAC rules. We will never advise you to break US law.

The steps, if it is legal for you

Find the property — see our Havana listings and ask for a live video tour.
Verify the title at the Registro de la Propiedad; the seller must match the deed.
Power of attorney — a poder notarial for a trusted person in Cuba, legalised through the Cuban consular section in Washington, D.C.
Sign at a Cuban notary with payment through a Cuban bank account.
Register the new title and keep certified copies.

Money transfers from Florida
